Good News: Referrals and AfBAREALTORS® and other settlement service providers are learning to adhere to Colorado's new Affiliated Business Arrangements law and new Commission Rules E-22 and E-46. These laws impose new limitations and requirements on referrals as well as affiliated business arrangements (AfBA). There has been confusion as to whether the word "affiliate" in the AfBA statute includes a mere referral relationship even if there is no direct or common ownership between the two service providers.
